1. Agreement and eligibility
By creating an account or using protected marketplace features, you agree to these Terms, the Acceptable Use Policy, Privacy Policy, hardware-safety rules, and any listing-specific terms agreed directly with another user. If you do not agree, do not use the service.
You must be at least 18 and legally capable of accepting these Terms, or use ProtoSell with valid involvement of a parent or legal guardian where permitted by law. If you act for an organization, you confirm that you have authority to bind it.
2. What ProtoSell provides
ProtoSell provides listing discovery, limited trust signals, protected previews, reporting tools, and a way for eligible users to reveal a seller's WhatsApp contact. The pilot is currently free. ProtoSell does not process payments, hold funds or files in escrow, arrange shipping, guarantee delivery, issue refunds, determine transaction disputes, or act as buyer, seller, broker, agent, university, or guarantor.
Buyers and sellers independently decide whether and how to communicate, contract, pay, deliver, license, or meet. Their direct agreement is between them. ProtoSell is not a party to it and cannot verify an off-platform payment or handoff.
3. Accounts
- Provide accurate information and keep it reasonably current.
- Protect passwords, devices, recovery methods, and one-time codes.
- Use one account for both buying and selling; do not evade restrictions through duplicate accounts.
- Notify Support promptly if account access may be compromised.
- Do not sell, transfer, lend, or impersonate another person's account.
An academic-email badge confirms only control of an eligible address at the time of verification. It does not verify identity, enrollment, ownership, project quality, academic permission, or transaction safety.
4. Seller responsibilities
By creating or publishing a listing, you represent that:
- You created the listed material or hold every right and permission needed to offer it.
- Your description, price type, media, hardware condition, test status, included items, and known hazards are accurate and not misleading.
- The package contains no malware, stolen credentials, private keys, unlawfully disclosed personal data, confidential material, or content you are prohibited from sharing.
- Your offer and any direct transaction comply with law, university rules, third-party licenses, export restrictions, and safety requirements.
- You will not claim that ProtoSell verified ownership, certified hardware, protected payment, guaranteed delivery, or approved academic submission.
Sellers remain responsible for licenses, taxes, delivery, support, warranties they choose to make, and commitments made to buyers.
5. Academic integrity
ProtoSell is for legitimate learning, reference, prototyping, documentation, components, and authorized reuse. You must not submit, enable the submission of, or misrepresent another person's work as your own coursework, examination, capstone, thesis, competition entry, employment assessment, or credential evidence. You must follow the rules of your institution, instructor, employer, and applicable law.
ProtoSell does not promise grades, marks, admission, certification, academic acceptance, plagiarism outcomes, or fitness for an assignment. A buyer's or seller's satisfaction does not make academic misconduct permitted. Accounts or listings connected to cheating, impersonation, plagiarism, or dishonest credentialing may be restricted or removed.
6. Content and platform rights
You keep ownership of content you submit. You grant ProtoSell a non-exclusive, worldwide, royalty-free license to host, scan, process, resize, generate safe previews from, display, and distribute that content only as reasonably necessary to operate, secure, moderate, and promote the listing within ProtoSell. This license ends when the content is deleted, except for limited backups, audit evidence, legal preservation, and content already used with separate permission.
ProtoSell's software, branding, design, and original content remain protected. Access to a preview is not a license to copy, redistribute, reverse engineer, or commercially exploit the seller's work. Any buyer license must be agreed directly with the seller in writing.
7. Moderation and termination
ProtoSell may review reports and may reject, limit, archive, remove, or restore content; restrict features; preserve evidence; or suspend or delete accounts when reasonably necessary to enforce policy, protect users or systems, respond to rights claims, comply with law, or manage material operational risk. We do not promise to pre-screen every listing and moderation is not an endorsement of content that remains.
Where appropriate and lawful, we will provide notice and a way to seek review through Support. Serious, repeated, urgent, or unlawful conduct may require immediate action.
8. Risks and disclaimers
Use the service, listings, files, previews, direct communications, and hardware only after your own assessment. To the fullest extent permitted by law, ProtoSell is provided on an "as is" and "as available" basis without implied guarantees of accuracy, availability, ownership, merchantability, non-infringement, quality, safety, compatibility, academic acceptance, or fitness for a purpose.
Scanning, previews, fingerprints, badges, moderation, and reports reduce some risks but do not prove authorship, eliminate malware, certify a component, or guarantee that delivered material matches a listing. Review the Hardware Safety Notice before handling components.
9. Liability and indemnity
To the fullest extent permitted by law, ProtoSell and its operators will not be liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages, or for losses caused by user content, off-platform communication, payment, delivery, academic discipline, unauthorized reuse, hardware handling, or another user's conduct. Where liability may lawfully be limited, aggregate liability will not exceed the amount you paid directly to ProtoSell for the service during the twelve months before the claim.
Nothing in these Terms excludes or limits liability, remedies, or consumer rights that applicable law does not permit us to exclude, including liability for fraud or other conduct that cannot lawfully be disclaimed. No sentence transfers to you a legal duty that mandatory law places on ProtoSell.
To the extent permitted by law, you will defend and indemnify ProtoSell against third-party claims and reasonable costs arising from your unlawful content, infringement, material breach of these Terms, or direct transaction, except to the extent caused by ProtoSell's own legally actionable conduct.
10. Governing law and changes
These Terms are governed by the laws of the Arab Republic of Egypt, without overriding any mandatory protection or forum right that applies to you. Courts and authorities with jurisdiction under applicable law may hear disputes. Before filing a non-urgent claim, the parties should attempt in good faith to resolve it through Support.
We may update these Terms for legal, security, or product reasons. Material changes will receive reasonable notice. If a provision is unenforceable, it will be limited only as necessary and the remaining terms will continue. These Terms do not create employment, partnership, agency, fiduciary, or franchise relationships.
